Overview
We process personal data only to the extent necessary to provide this website and to handle your enquiries. This policy explains which data is involved, for what purpose and on which legal basis we process it, to whom it is transferred and how long it is stored.
You are not required by law or contract to provide your data. Without your name, email address and message, however, we cannot process an enquiry via the contact form. You can also reach us by email or phone.
No automated decision-making, including profiling, takes place.
Provision of the website via Cloudflare
This website is provided via Cloudflare Workers, a service of Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA. Cloudflare operates a worldwide network of data centres. Requests are usually answered by a data centre near you.
When you visit the website, Cloudflare processes technically necessary connection data, in particular:
- your IP address
- date and time of access
- the requested address (URL) and type of request
- technical information about your browser and operating system
This data is required to deliver the website and to protect it against attacks and misuse. The legal basis is Art. 6 (1) (f) GDPR. Our legitimate interest lies in providing the website securely, reliably and quickly.
We ourselves only log technical error messages, for example if an enquiry could not be delivered. These do not contain the content of your enquiry. They are stored in the Cloudflare Workers Logs service and deleted automatically after three or seven days, depending on the plan. We do not log each individual page view.
For processing on our behalf, Cloudflare provides a data processing agreement (Data Processing Addendum) which, according to Cloudflare, forms part of the customer agreement. Processing in the USA is possible. For such transfers, Cloudflare states that it relies on the EU-US Data Privacy Framework and, in addition, on the European Commission’s standard contractual clauses. Where Cloudflare processes data under its own responsibility to protect and operate its network, Cloudflare’s privacy policy applies: www.cloudflare.com/privacypolicy/
Contact form and enquiries by email or phone
When you contact us via the contact form, we process the following information:
- name
- email address
- phone number, if you choose to provide it
- requested service
- your message
In addition, the technical connection data described above is processed. To prevent misuse, the server checks that the request originates from this website, and the form contains a field that is invisible to humans and detects automated spam submissions. No additional data about you is stored for this purpose.
We use your information to process your enquiry and, where applicable, to prepare a quote. If your enquiry relates to entering into or performing a contract, the legal basis is Art. 6 (1) (b) GDPR. For other enquiries, the legal basis is Art. 6 (1) (f) GDPR; our legitimate interest then lies in responding to enquiries addressed to us.
The form data is not stored in a database on this website. It is sent directly as an email via the email delivery service Resend to our business mailbox at STRATO (see below). If you contact us directly by email or phone, we process your information for the same purposes and on the same legal bases.
Email delivery via Resend
To deliver form enquiries to our mailbox, we use the Resend service of Plus Five Five, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA. This involves processing the form data as well as technical delivery data such as sender and recipient address, time and delivery status.
We have selected Ireland (EU) as the sending region. This setting only affects the delivery route. According to Resend, message content and delivery logs are stored in the USA.
Resend acts as our processor on the basis of the data processing agreement pursuant to Art. 28 GDPR (Data Processing Addendum) which, according to Resend, forms part of the terms of use: resend.com/legal/dpa For transfers to the USA, this agreement provides for the European Commission’s standard contractual clauses. In addition, according to Resend, it has self-certified under the EU-US Data Privacy Framework.
According to Resend, message content and delivery logs are stored for 30 days on the regular plans. The legal basis for using Resend is Art. 6 (1) (f) GDPR; our legitimate interest lies in the reliable delivery of your enquiries. More information: resend.com/security/gdpr/
Business mailbox at STRATO
We receive, store and answer enquiries submitted via the contact form and emails to info@kscleanandservice.de in our business email mailbox at STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany.
STRATO processes the data as our processor pursuant to Art. 28 GDPR. According to STRATO, the data processing agreement forms part of all contracts concluded since 18 July 2022. The legal bases are the same as for the contact form.
Retention period
We only store your data for as long as is necessary for the respective purpose or as required by statutory retention obligations. Specifically:
- Contact enquiries that do not result in an order are deleted no later than six months after processing has been completed, unless legitimate or statutory reasons for retention apply.
- Spam and test enquiries are deleted as soon as possible once dealt with.
- If an order is placed, we keep the documents only for as long as necessary or required by law. Invoices are generally subject to a statutory retention period of eight years; business letters subject to retention requirements may be subject to a period of six years.
- According to Resend, message content and delivery logs are stored for 30 days on the regular plans.
We review our mailbox regularly and delete enquiries that are no longer needed.
Cookies, local storage and tracking
This website itself does not set cookies and does not store any information in your browser, such as in local storage. We do not use analytics or advertising services, tracking pixels, embedded maps, videos or social media content, or externally loaded fonts. Fonts and images are served from our own website.
If Cloudflare protection features against automated access are active, Cloudflare may set a strictly necessary security cookie (for example “__cf_bm”). It is used solely to fend off abusive access, is not used for analytics or advertising, and is deleted after a short time. The legal basis is § 25 (2) no. 2 TDDDG (German Telecommunications Digital Services Data Protection Act) in conjunction with Art. 6 (1) (f) GDPR.
Your rights
You have the following rights with regard to your personal data:
- access to the data stored about you (Art. 15 GDPR)
- rectification of inaccurate data (Art. 16 GDPR)
- erasure of your data (Art. 17 GDPR)
- restriction of processing (Art. 18 GDPR)
- data portability (Art. 20 GDPR)
- objection to processing (Art. 21 GDPR)
- withdrawal of consent with effect for the future (Art. 7 (3) GDPR), where processing is based on consent
To exercise your rights, simply send a message to info@kscleanandservice.de or to the postal address stated above.
Right to object
Where we process your data on the basis of Art. 6 (1) (f) GDPR, you have the right to object to this processing at any time on grounds relating to your particular situation. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Right to lodge a complaint with a supervisory authority
You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg (Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg): www.baden-wuerttemberg.datenschutz.de
